ABA Technology Competence — The Standard of Care

The American Bar Association's Model Rule 1.6(c) requires lawyers to “make reasonable efforts to prevent the inadvertent or unauthorized disclosure of, or unauthorized access to, information relating to the representation of a client.” What constitutes “reasonable efforts” depends on the sensitivity of the information, the likelihood of disclosure, the cost of additional safeguards, and the difficulty of implementing them.
